Terms of Service
These terms govern your use of flexlist. By paying for a rank you agree to them.

1. Who you are dealing with
flexlist (the “Service”) is operated by Tomáš Spáčil, Edmunda Husserla 1213/3, 779 00 Olomouc, Czech Republic, business ID 22511334 (“we”, “us”). Contact: hello@flexlist.net.
Payments are processed by a third-party payment provider acting as merchant of record. That provider is the seller of record for your purchase and handles card data and applicable sales tax. We never receive or store your card details.
2. What the Service is
The Service is a public leaderboard. You pay an amount of your choosing and receive a public profile whose position is determined solely by that amount, as described in the rules, which form part of these terms.
You are buying a position on a public list and the display of the content you submit. You are not buying advertising performance, traffic, clicks, exposure, a permanent position, or any commercial outcome.
3. Eligibility
- You must be at least 18 years old.
- You must be legally able to enter into a contract in your country.
- You must use your own payment method, with the account holder's permission.
4. Ranking and payment
- Amounts are whole US dollars, $10 minimum and $1,000,000 maximum per payment.
- Rank is assigned when the payment is confirmed by the payment provider, not when checkout is opened. If your position is taken while you are paying, you receive whatever position your amount then supports.
- Taking first place costs at least $5 more than the current first place on that board.
- If you already hold a profile, raising your rank charges only the difference between your current total and your new total.
- Ranks are relative. Another user may pay more at any time and move above you. This is the entire mechanic of the Service and is not a defect.
5. No refunds
All payments are final and non-refundable. This includes, without limitation: being outranked by another user; your position falling on the rolling 24-hour or daily boards; receiving fewer clicks, visitors or attention than expected; changing your mind; and removal of your listing for breach of these terms or the rules.
The digital content is delivered immediately upon confirmation of payment. Where a statutory right of withdrawal would otherwise apply to consumers, you expressly request immediate performance and acknowledge that you lose that right once your listing is published.
This does not affect mandatory statutory rights that cannot be excluded under the law applicable to you, and does not apply where a payment was made in error by us or where the Service failed to publish your listing at all.
6. Your content
You are solely responsible for everything you submit — your display name, description, link, avatar and any other content. You confirm that:
- You own it or have the right to publish it.
- It does not infringe anyone's rights, including intellectual property, privacy and personality rights.
- It does not contain personal data about anyone other than yourself.
- It does not impersonate any real person or organisation, and does not falsely suggest endorsement or affiliation.
- It complies with the rules.
You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and distribute that content in connection with operating and promoting the Service, including in automatically generated preview images and social media cards. This licence continues for content that remains part of the permanent public record described in section 8.
7. Moderation and removal
Listings are published immediately and reviewed afterwards. We may remove or edit any listing, at our discretion and without prior notice, if we consider that it breaches these terms or the rules, exposes us to legal risk, or damages the Service.
Removal of a listing does not entitle you to a refund of any amount paid, in whole or in part.
We may also refuse service, cancel a pending checkout, or block a payment method or email address where we reasonably suspect fraud, abuse or a chargeback risk.
8. Publicity and permanence
The Service is deliberately transparent. Your profile, the amounts you pay, the times of your payments and your rank history are public and may be indexed by search engines, archived by third parties, and included in aggregate statistics. Payment records are retained for accounting and anti-fraud purposes even after a listing is removed.
Do not publish anything here that you would mind being permanently associated with you.
9. Availability
The Service is provided “as is”. We do not guarantee that it will be available without interruption, error-free, or that any particular position, traffic or search engine treatment will result from your purchase. We may change the design, the boards, the pricing rules or the categories at any time. Changes to pricing rules do not apply retroactively to payments already made.
We may discontinue the Service. If we do so, listings paid for within the preceding 30 days will be refunded pro rata where the payment provider permits; no other refunds arise.
10. Liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the total amount you paid to us in the twelve months preceding the event giving rise to the claim.
We are not liable for indirect or consequential loss, including lost profits, lost business, lost reputation or lost opportunity. Nothing in these terms excludes liability for death, personal injury, fraud, or any other liability that cannot lawfully be excluded.
11. Chargebacks
If you initiate a chargeback or payment dispute, we may remove your listing and refuse further service. Because rank is public and immediate, a successful chargeback after publication removes the rank you obtained.
12. Changes to these terms
We may update these terms. The version in force at the time of your payment governs that payment. Continued use of the Service after a change means you accept the updated version. The date at the top of this page shows when it was last changed.
13. Governing law
These terms are governed by the laws of the Czech Republic, and the courts of the Czech Republic have jurisdiction. If you are a consumer resident in the European Union, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may also bring proceedings in the courts of that country.
Consumers in the EU may use the European Commission's online dispute resolution platform. In the Czech Republic, the competent body for out-of-court consumer dispute resolution is the Czech Trade Inspection Authority (Česká obchodní inspekce), coi.cz.
